General Conditions of Sale
By registering to bid, in person or online, you accept the General Conditions of Sale below. Scottish Law applies to the interpretation of these Conditions of Sale.
Buyer’s premium
The buyer shall pay the hammer price together with a premium of 20% of the hammer price (the premium attracts VAT at the standard rate), payable by all purchasers. Lots purchased online via our website are subject to an internet commission charge of 3% + VAT.
Artist’s Resale Right
Certain items incur a Droit de Suite charge (indicated in catalogues with the * symbol). Under Artist’s Resale Right legislation, auctioneers are required to collect royalty payments for all works of art by living artists and artists deceased within the previous 70 years, sold above a hammer price of £1,000. The royalty of 4% of the hammer price is charged to the buyer in addition to the buyer’s premium and is not subject to VAT. All royalty charges are paid to the Design and Artists Copyright Society (DACS).
Payment and collection
The buyer must pay for and remove all goods within 7 days of the sale date, otherwise storage charges will be levied. Goods purchased will not be released until full payment has been received.
Forgeries
If within seven days after the sale the Auctioneers receive written notice from the buyer that in their view a lot is a deliberate forgery, and within seven days after such notification the buyer returns it in the same condition as at the time of sale and satisfies the Auctioneers that, considered in the light of the catalogue entry, the lot is a deliberate forgery, the sale will be rescinded and the purchase price refunded.
Commission bids
Instructions given by telephone are accepted at the sender’s risk and must be confirmed in writing at least one hour before the sale commences. It is the responsibility of all persons leaving such bids to ascertain immediately after the conclusion of the sale whether they have been successful.
Inspection
Ample opportunity is given for inspection, and each purchaser, by making a bid for a lot, acknowledges that they have satisfied themselves fully before bidding as to the physical condition of the lot, including whether it is damaged or has been repaired.
General
Browns disclaim responsibility for default by either the buyer or the vendor because they act as auctioneers, and reserve the right to withhold payment to the vendor until payment is received from the buyer. Every person on the sale premises shall be deemed to be there at their own risk. Browns have the right to refuse admission to their premises or attendance at the auctions by any person. Vendors and buyers give Browns the right to photograph and illustrate any lot placed with them for sale.
